These Terms of Service (“Terms”) govern your access to and use of the Apex platform (“Apex”, “we”, “us”). This is a placeholder draft for the pre-launch beta and will be replaced with the final agreement before any real capital is accepted. By creating an account you agree to the terms below.
1. Beta Service
Apex is currently operated as a closed beta. All trading activity is simulated using paper accounts. No real money is deposited, invested, traded, or withdrawn through the beta platform. Performance shown is for illustrative purposes only and does not represent actual results.
2. Eligibility
You must be at least 18 years old and legally capable of forming a binding contract. You must provide accurate registration information and keep your credentials secure. Apex may suspend or terminate access at its sole discretion during the beta.
3. No Investment Advice
Information displayed on Apex — including AI-generated reasoning, strategies, watchlists, and performance — is for informational purposes only and does not constitute investment, legal, or tax advice. You are solely responsible for evaluating any information before acting on it.
4. Acceptable Use
You may not reverse engineer, scrape, or redistribute content from Apex; attempt to gain unauthorized access to systems; submit malicious content; or use the platform to violate any law. We may rate limit, throttle, or disable accounts that misuse the service.
5. Intellectual Property
All software, models, branding, and content remain the property of Apex or its licensors. You retain ownership of content you submit, but grant Apex a worldwide, non-exclusive license to use it for operating and improving the platform.
6. Disclaimer of Warranties
The beta is provided “as is” and “as available” without warranties of any kind. Apex does not warrant that the service will be uninterrupted, secure, or error-free, or that any performance shown will be achieved in the future.
7. Limitation of Liability
To the maximum extent permitted by law, Apex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
8. Changes
We may update these Terms during the beta as the product evolves. We will notify active users of material changes before they take effect. Continued use after an update constitutes acceptance.
